Your Rights Roxboro Lighting Limited trading as Onlinelightshop is a UK based company and complies with UK consumer law including the Distance Selling Regulations. This means that shopping with Onlinelightshop is safe. With 30 years experience in lighting retailing we aim to give a thorough and relable sevice, you’ll get your items delivered and we’ll sort out any problems you have. Our Terms and Conditions do not affect your statutory rights. Distance Selling Regulations give you the right to cancel an order and return any goods that may already have been dispatched, (see Returns for Refund) up to 7 days from receipt. Our returns policy allows 21 days.

General Clauses

Pricing

Prices include VAT  (Value Added Tax)*, standard UK rate 20%. VAT does not apply to orders that are to be shipped outside the E.U. or to Tax Free areas such as the Channel Islands. These areas will be priced and billed with VAT deducted. The prices on the site are shown including VAT.

If you select a currency or a delivery country outside the E.U., prices will be displayed VAT free, for example, an item which costs 19.99 GBP will be shown and billed as 17.00 GBP when it is VAT free.

While we do our best to ensure prices are up to date and correct, errors may occur and in this case you will be contacted before your order is shipped.

Payment

Onlinelightshop accept most major credit cards for online orders. You will be asked to enter your card details and the name and the address of the card holder when you place the order. These details will be checked and we may hold an order until we receive the correct details. You will be contacted if we find the card or address details to be incorrect. We only bill your card when your order is ready to be dispatched.

For offline orders Onlinelightshop accept (£) Sterling Postal Orders, Personal Cheques, (£) Sterling Bank Drafts and (£) Sterling Bank Transfers. We recommend that you do not send cash through the post. Due to varying Exchange Rates all payments made to CRC must be in UK Pounds (£) Sterling.

Product Availability

Onlinelightshop endeavours to carry most of the items displayed on the site in stock. If an item you order is out of stock we will contact you with a due date. You may then wish to cancel the order or wait until the item becomes available.

Out of Stock Orders

There are times when items become temporarily out of stock. If you order an 'Out Of Stock' product, we will send out the order to you as soon as the product becomes available again. If we cannot source the item we will contact you to inform you. Your credit card will not be debited until we dispatch the product.

Accuracy of Information

We put a lot of time and effort into describing and photographing the products we sell using manufacturer's websites, catalogues, our own photography studio and often our own descriptions of the products. Although we aim to ensure that every picture and description is 100% accurate, mistakes do occur so let us know if you see or read something that isn’t correct. If you have purchased something based on a picture or description on the website which turns out to be incorrect we will be happy to replace or refund the product (unused).

Changes

If we decide to change our Terms and Conditions, we will post those changes on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.

Site Usage

Onlinelightshop disclaims damages of any kind, compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties implied or otherwise relating to use of this site.

Credit Card Security

We take online security extremely seriously and have taken several steps to ensure that your payment information is processed confidentially and accurately. We use Sagepay, a world leader in secure online payments.

Onlinelightshop offer the use of secure servers where information is protected by Secure Sockets Layer (SSL), the industry standard encryption technology. SSL works with Netscape Navigator, Microsoft Internet Explorer, AOL and other browsers. This encryption makes it virtually impossible for unauthorised parties to read any information that you send us.

When your order is processed your encrypted credit card number is removed from the web server.

This means that there is no way that someone can obtain your credit card number from Onlinelightshop so you can order with confidence!

1. DEFINITIONS

1.1 "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;

1.2 "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;

1.3 "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;

1.4 "Goods" means the articles that the Buyer agrees to buy from the Seller;

1.5 "Seller" means www.onlinelightshop.com of Roxboro Lighting Limited T\A Moy Lighting Centre, 36 Charlemont Street, Moy, County Tyrone

1.6 "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.


2. CONDITIONS

2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

2.3 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

2.4 Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2.5 All offers, promotions and services are available for the exclusive use of web customers only and cannot be repeated in any Roxboro Lighting Ltd retail outlets.

3. ORDERING

3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

3.2 Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order. No payment will be processed by the seller until such time as the Goods are ready to be despatched.

3.3 When making an order through the Website, the technical steps the Buyer needs to take to complete the order process are described in the order checkout process.

4. PRICE AND PAYMENT

4.1 The Price of the Goods shall be that stipulated on the Seller’s Website. The Price is NOT INCLUSIVE of VAT. The Price EXCLUDES delivery charges.

4.2 The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order.

4.3 After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.

4.4 Payment of the Price plus VAT and delivery charges must be made in full before dispatch of the Goods.

4.5 Payment must be made by secure credit or debit transactions (please see Privacy Statement).

5. RIGHTS OF SELLER

5.1 The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.

5.2 The Seller reserves the right to withdraw any goods from the Website at any time.

5.3 The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

6. WARRANTY

6.1 The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.

6.2 All Goods are guaranteed by the Seller for 1 Year from the date of receipt against defective parts, materials and/or manufacture. Installation of Goods carried out by any person other than a fully qualified and insured electrician AND/OR where Goods have become compromised as a result of misuse will render this guarantee void.

6.3 After 7 Working days from the date of delivery goods will be repaired or replaced dependant upon the nature of the fault.

7. DELIVERY

7.1 Goods supplied within the UK will normally be delivered within 3-5 working days of acceptance of order.

7.2 Where a specific delivery date has been agreed, and where this delivery date cannot be met, the Buyer will be notified and given the opportunity to agree a new delivery date or cancel the order.

7.3 The Seller shall use its reasonable endeavours to meet any date agreed for delivery. In any event, time of delivery shall not be of the essence, and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

7.4 Delivery of the Goods shall be made to the Buyer’s address specified in the order which must be the same address registered to the card tendered for payment. Under no circumstances will delivery be permitted to any other address. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

7.5 Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.

8. CANCELLATION AND RETURN

8.1 The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller via the designated Returns Submission Form within 7 working days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.

8.2 Where a claim of defect or damage is made the Seller shall be responsible for the recovery of the Goods from the Buyer. The Buyer shall be entitled to a full refund (including delivery costs) if the Goods are in fact defective.

8.3 If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller via the Returns Submission Form within 7 working days of receipt of the Goods.

8.4 Goods must be returned by the Buyer at the Buyer’s expense and received by the Seller no later than 7 working days from the date of returns notification and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (including delivery charges, if any) except for return postal charges within 30 days of cancellation.

8.5 The Seller reserves the right to refuse a refund if:

8.5.1 The Goods have been used.

8.5.2 The Buyer has not advised the Seller using the Returns Submission Form prior to returning the goods.

8.5.3 The Goods are returned without the original packaging intact.

8.5.4 The Goods are returned missing parts.

8.5.5 The Goods are returned outside permitted time allowance.

9. LIMITATION OF LIABILITY

9.1 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

9.2 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

10. WAIVER

10.1 No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

11. FORCE MAJEURE

11.1 The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

12. SEVERANCE

12.1 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

13. CHANGES TO TERMS AND CONDITIONS

13.1 The Seller shall be entitled to alter these Terms and Conditions at any time, but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

14. GOVERNING LAW AND JURISDICTION

14.1 These Terms and Conditions shall be governed by and construed in accordance with the law of UK and the parties hereby submit to the exclusive jurisdiction of the UK courts.
